i'm mark k t to talk about in good morning. 7:30 on sunday, may 4th. thank you for joining us. >> there's a whole bunch of news to share in the next hour. >> we're talking about one of the hottest congressional races this election season. right here in the silicon valley and last night there was a debate between an established incumbent and tech savvy rich newcomer. that has the makings of a political pattern we saw last election year in the bay area. we'll talk about that. >> and the hot debate in san francisco. should you be allowed to renounce your place for those coming in for the week or weekend? it's a hot topic. we sit down with the backer of an initiative to take the whole matter to voters.

>> another one, donald sterling. recognize that name? the nba made a big move. they are going to put a new person in at the helm. what does that mean for donald sterling's fate? we'll talk about it [do we even care this much about this issue? i didn't even know his name before this all blew up. suddenly - >> we're talking about who else is going to be taking heat for this. some interesting people on the sidelines that got hit with this as well. >> we have a lot coming up obviously but first a check of our weather forecast today. a live look outside at san francisco. some clouds in the sky, if you look closely you can see the golden gate bridge in the background. temperatures now upper 40s to low to mid-50s all around the bay area. it's going to be a little cooler today than what we saw yesterday. but not much. plenty of morning clouds, partly cloudy this afternoon. a little breezy as well. we'll have the 5-day forecast coming up in a few. the golden state warriors fought the fight against the clippers in game seven of the

nba playoffs but many are waking up upset. coming up five points short with a score of 126-121. bay area basketball fans supported the boys in blue and gold in a rare winner take all finish to the series. on the war path for golden state, serge curry who led his team with 44 points. >> we were not satisfied just being a 60. we had injuries. we felt we still had a chance to win the series. very frustrated and disappointed. for sure. >> reporter: despite the disappointing end to an amazing run by golden state the san francisco mayor praised the players for going the distance. he made this statement -- playoff appearances in 20 years." as for the donald sterling controversy... the n-b-a now says the clippers will a new leader. it will >> reporter: as for the donald steeling controversy the nba now says

the clippers will have a new leader. it will appoint the ceo to oversee the clippers. that person will run the entire operation. however, sterling could fight the decision in court. abc's barbara walters says sterling agreed to an interview with her friday but then backed out. we're following some developing news in san francisco this morning. police have several people in custody after chasing a suspect with a gun. you can see two of the suspects in the video. they say one man tried to escape to a building at 6th street at 10:45 last night. the area was evacuated, street closed to both cars and pedestrians. the police eventually detained three people. in richmond the gunman in a shooting on highway 580 is still on the loose. it happened at regatta boulevard causing an suv to crash into thester divide and flip over. the center divide and flip over. the driver was killed. witnesses say a driver in a

blue ford suv fired spots while speeding down 580. traffic was snarled for hours yesterday while all eastbound lanes of the freeway were shut down around -- until 5:30. one of the most heated congressional races. newly redrawn district in the south bay is up for grabs. >> has democrats duking it out. the incumbent refused to debate his opponents up to this point. but it's chained. >> reporter: supporters made a loud case for their democratic candidate. these for the challenger. and these for the incumbent. but if voters were looking for fire they were out of luck. with the democratic candidates and lone republican who showed up more agreeable than argumentative. >> do you support limits on campaign contributions, mr. honda? >> yes. >> absolutely. >> absolutely, yes. >> reporter: what should

immigration law contain? >> we need to increase the h1b cap regardless of what anyone says about borders and giving away american jobs. >> reporter: the visa allows silicon valley to bring in high-tech workers from other countries. >> we need to realize that immigration helps create jobs, it's a no-brainer. but i believe we've put together a bill the president of the country says he's willing to sign. >> reporter: and faking -- taking credit for tesla. it ended on a cordial note. >> i would like to thank my opponents. you are more charming than in the papers. >> i would like to thank the gentlemen as well. >> reporter: it was a very civil forum. no knockout punches.

don't k -- don knapp, kpix5. >> there was a time when honda would have been largely unopposed. now younger democrats, it's the second time going after older ones. >> the smacks of the situation we saw in the east bay. it puts more established incumbents on their toes. they can't rest on their laurels anymore and also there seems to be with a newer generation more reaching out to the voters, in technological ways. i think voters are coming to expect more as far as involvement from their politicians. >> don't forget honda's records, or incumbent records can stand pretty well too but the most important part, you can have two democrats in the race in the second one and republicans sort of being the decider if the democrats are split. that is going to be -- we'll

see how that plays out. meanwhile, berke low police want to be able to/berkeley police want to be able to use tasers and this week they will go again before the city council to ask for a report of the benefits of using tasers on the force. there is significant opposition to tasers, it will be a controversial issue, people worrying they will use them improperly. >> this is a debate of course we'll receiver all over the bay area. many in san francisco still discussing this as well. you made the point, you don't know if they are going to use the tasers correctly so you just give them a gun and run with that. >> a tough one but a very politically charged issue out there. because people see this and say are they are being used properly? this is a time web they are

cutting budgets. we'll see where it all goes as well. how much money does your boss make compared to you? there's a bill advancing through the state legislature that could change things. it would punish companies that pay their ceo's more than 100 times the median wage of their workers by making them pay more taxes. companies with less of a wage gap would be rewarded with a lower corporate tax rate. supporters of the bill which just passed the senate committee say income equality is getting too far off kilter. in fact they were paid an average of 354 times more than the median employee. >> that's right. we're going to be sitting down with the state senator from concord who is authoring that bill and ask him a little about what he thinks the downside is and possible effects of that. will businesses move out? >> it's the first of its kind in the nation. he's trying to be a trendsetter

offered by web sites like a b-n-b. backers say limits are necey to address the there's a push in san francisco to restrict short term rentals. >> backers say limits are necessary to address the city housing shortage and affordability crisis. a proposed ballot initiative would restrict shortterm rentals to neighborhoods with commerce zoning. it would also require permission from landlords or homeowners associations and reward people who inform on hosts breaking the rules. >> from the backers' point of view are the restrictions necessary and would they make a difference in easing the city's housing crunch?

one of the those joining me isdale carson -- dale carson. as it stands now, it's illegal in san francisco to do short term rentals unless you have a permit so why not just enforce the laws we have now? >> that's true. outside of neighborhood commercial zoning districts shortterm rentals are illegal as of right now. this issue came up about two years ago. the mayor formed a sharing economy working group that was supposed to take a look comprehensively at new rules and regulations to govern short term rentals and other so-called sharing economy companies. that company never met. the city ruled two years ago that sheeterterm rentals -- short term rentals were subject to the city's hotel collections. they were never collected. david chu was supposedly working on this two years ago. we never saw - >> was the city not enforcing its own laws? >> the city not enforcing the

laws. we looked at three of the three top short term rental sites in the country. we found nearly 10,000 units available for shortterm rentals in san francisco. >> what is wrong with shortterm rentals? >> it deprives the city of needed affordable housing at a time when we're facing the worst housing crisis. >> if someone rents outs their home for a weekend or an apartment for a weekend while they are away how does it affect the housing market? >> that's not what we're seeing. we're seeing landlords renting multiple units full time. in fact becoming de facto motels or hotels. >> yes, that's what the city attorney is suing them over. we have tenants renting four and five units with the sole purpose of listing them for short term rentals. neighbors are complaining about transients coming through all the time not respecting the property. landlords are losing their insurance when the companies find out that shortterm rentals are going on in their business. tenants are being evicted.

it's a world of problems. >> you want to take an initiative to the ballot to do what? >> to do shortterm rentals you have to be registered with the city. when you register you have to certify that a, you have appropriate levels of insurance. you have permission from the landlord or hoa and applying with all applicable codes. >> i'm a little at a loss. it sounds so typically san francisco. you have a law that dictates how this should be done. what you're talking about. and they are choosing for political reasons or whatever because it's popular now not to enforce the law so we want to ask the voters to pass another law to do what we have a law already to do. >> after you've registered, for the listing company can list the unit they have to verify you're registered. if either of those things don't happen there's a private rite of action that you can bring to force the city to go after them. >> in other words we have

people informing on the neighbors or something like that? >> which they are doing now. >> explain to me the politics of this. like i said, if we have laws that govern this and choose not to enforce them why do we have to go to the voters and say pass something we have already on the books. >> to get the city's attention. to make them enforce the law. >> why doesn't the city want to enforce the law? >> that's a good question. i think partly it's because the mayor is so smitten with technology and with this notion of a sharing economy. that he would like to see it flourish in the city. we would too but let's be honest, the sharing economy, money is changing hands, middle men are taking cuts, i see renting. i don't see sharing. >> all right. well, like you said it's going to be an interesting -- this is a national topic. going on from new york to los angeles. thank you for joining us. if you make it to the november ballot we're going to have you back because it's definitely something we're going to want

over the next seven days it's going to stay cool and then we're going to see a little more sunshine and u.s. going to heat up as we go into next weekend. very good weather today to hit the streets of san francisco for sunday streets. today's event takes place in the dog patch and bayview districts. this is the embarcadero a couple of months ago. comfortable walking shoes, food and music, starts 11:00 this morning. oakland's fruitvale district is having a cinco de mayo celebration. on east 12th street. there will be aztec dancers and other live music between 33rd and 35th avenues, two mariachi bands along international boulevard. today's event is intended to showcase local talent and restaurants in the area. shaping up to be a fiery cinco demayor myodell -- cinco de mayo celebration. in the south bay there was an

incident four years ago involving the american flag. >> len ramirez on the controversy. >> reporter: a single american flag in front of the high school here in morgan hill but soon there will be many more like it, at least 50 flag waving tea party patriots from the morgan hill area and a unknown number of outsiders plan to rally outside of the school on cinco de mayo. >> they silenced a symbol of patriotism in america. >> reporter: an appeals court ruling in february upheld the school's decision in 2010 to make four boys go home, turn over or take off their american flag t-shirts out of concern for all students' safety. they wore the shirts at a cinco de mayo celebration as to what was a high point in race relations at the school. conservative radio host jimmy z

broadcast nationwide. >> there are people thinking of driving down to the bay area, from oregon, nevada. >> reporter: violent messages on conservative web sites. >> general thets basically saying if there's going to be riots basically let them riot. basically target practice. >> reporter: high school parent and attorney juan lopez plans an alternate rally by his group we the people and students are speaking out asking all the adults at the recent school board meeting to stay away. >> just let it go. >> reporter: morgan hill police say they will have a contingency plan in place, to bring officers in on o'overtime and seek mutual aid from other departments if needed. >> threats were posted anonymously on a nationwide blog, not a local conservative web site. hollywood isn't what it used to be. lights, camera, but little action thanks to other states getting out in movie

making it easier for film executives to do things in california, changing regulations and increasing tax credits to encourage filming here. how do you think that is going to go over? >> an interesting dynamic. your legislature now wants you to be from hollywood. according to legislative analyst report for every dollar in tax credit we get about 65 cents back returned. in hollywood that is good for your economy but what lodi? what are you getting out of the deal? >> right. >> if you don't have a movie you don't come up with a winner. in about 30 days the voters are going to go to the polls for the first round of the elections for the state legislature. >> there appears to be a real split amongst the democratic candidates, toes backed by business and those backed by labor. >> that's right. both are spending big money and hitting each other very hard. we asked our political insiders willie brown, no stranger to political infighting and carla marinucci of the san francisco chronicle for their take on this demolition derby.

>> for the first time the top two vote getters can advantage to the gem election. that means businesses in many cases have to weigh in to the contest and they are picking -- the more money is going into them, who is more friendly to businesses? >> labor isn't shy either. they are putting in independent expenditures -- why are you supplying? >> i love her -- why you are smiling? >> i love her knowledge of this. it's all true. >> labor, business, millions of dollars going into that race. >> the california teachers association put a lot of independent expenditures behind the dublin mayor. the adviser to jerry brown is backing the ban on bart strikes, labor doesn't like him. this is really turning into a

huge battle. >> it's totally and completely new. you would only see this in the fall campaigns in previous years. then would have been republican versus democrats. jim brophy, head of the republican party will tell you that they are somewhat delighted. previously they were not involved at all in a contest, let's say in west oakland that would be in the fall, a democrat who is unopposed. now, with the business community the republicans can have the moderate democrats and you'll end up with the moderate democrat winning it, not the liberal democrat. >> second one, race is the one that has -- let me see, former state assembly woman mary hyoshi, current assemblyman bob okowski for the campaign. you he put up a video of her

from the shoplifting convention. >> she denied it. this is someone convicted, on probation for the charge, $2,500 out of neiman marcus? she just backed her campaign to reverse - >> you know my view on managing candidates. over the years i would never ever permit a candidate i'm supporting as speaker to walk into a place where they had no possibility of getting the endorsement or get a vote. don't waste your time. mary never should have gone to any interview with any news organization. she's damaged merchandise. she should be some place saying a prayer and hanging out with mother theresa. >> the issue of money and politics, from business or labor, wherever you're coming from, it's a huge issue.

the only thing that is going to counteract that is if voters pay attention to what the politicians are doing. >> there could be a mandate on organized labor. the bart strike is the big issue. are you still feeling anger about that? and should something be done. looks like that strike is lingering on a little longer than people might have thought. >> let's not forget that bart strike, really. >> all right. coming up -- a tool that could save your child's life. why so many teachers are fighting to keep it out of the classroom. ,,,,,,,,,,,,,,,,,,

the two didn't travel together. those are a look at the top stories. back to you. quick check of the weather forecast, a live look outside at the bay bridge. you can see plenty of clouds in the sky but a little bit of sunshine peeking through this morning. temperatures already warming up to the mid to upper 50s all around the bay area. we're going to see the clouds sticking around this afternoon. staying cool and breezy at times. going to be pretty similar to what we saw yesterday. we'll have the 5-day forecast coming up in a few minutes. regulating the berkeley drone zone is going to be the subject of a special meeting tomorrow. >> city leaders in berkeley weighing the pros and cons in the city's airspace. drones are unmanned aircraft and the technology has been getting hot. a couple of commissioners are calling for a no-drone zone over berkeley banned -- but the city council members argue that drones can help first responders during search and rescue missions. >> the city doesn't have any jurisdiction over its airspace.

it's the faa, so it's a made up crisis, ok? >> the data that can be acquired through niece drones will feed into the national network of security and surveillance. >> that special meeting is tomorrow at 2:30 at berkeley city hall. the council plans to vote on it this fall. there are a lot of practical applications. we talked about helping search and rescue missions. everything down to monitoring gas leaks, checking for cracks in wind turbines. >> privacy advocates are concerned about what the drones see, not necessarily when they get to the situations you're talking about but on the way and are they going to be collecting information. not just berkeley, alameda county also has a deadlock on that as well. here's something that is not at a deadlock. president obama is going to be back in the bay area again this thursday, again to collect money for the democratic national committee. the main event is a fundraiser at the mountainview headquarters of the start-up

called y combinator. earlier the same day the president will star in a tech roundtable in los altos, home of the co-founder of 23 and me and tickets there run more than $32,000. >> what can you expect out of that visit? >> more of the same. it's money. that's what it's about. meanwhile, we have a debate in california about whether it's a good idea to train teachers to use the epipen. >> students in danger of losing consciousness often need it meet -- immediately. >> and to train someone on staff to use it in an emergency. >> the bipartisan bill is getting support from health associations, teachers unions are against it. >> teachers are highly trained in teaching children. they are not highly trained in delivering medical services.

>> the california teachers association says the answer is to hire more school nurses. backers of the proposed bill say there would still be a gap if the nurse is on vacation or field trip. and a teacher cannot teach if child safety is at risk. the california teachers association, california school employees association, california federation of teachers all raised questions of training and such. i think to a lot of parents they say if you're doing cpr or something else like this and this is available why not have it? still ahead, donald sterling's racist remarks from -- and swift reaction. >> the public opinion came out so hard on this that the nba has no choice but to react strongly. >> controversial history and political insiders explain this was the last straw. why some bay area cities are facing mandatory restrictions of water use when other parts of our area aren't even hearing about the drought.

but is it possible for the government to enforce a taxo the gaps in pay between chief executives officers and workers is growing. no surprise. >> can the gap be filled? >> the state senator is here to give it a shot. he'll talk about a bill he has that punishes corporations that pay their ceo's more than 100 times the median age of their workers but would give breaks to those that don't? >> yes. >> tell me a little about this. >> it's one bill, part of a series of bills, something that comes out epic to ending poverty in california that i started last year. the employee/ceo compensation all after world war ii was 30% above the median. now almost 300%. most of the benefit of the recovery, 95% of that has gone to that 1%. so a lot of us think and history teaching us it's bad for the economy and bad for democracy. >> the capitalist system is based on you make what you can and when the government gets

involved we have possible socialist states and doesn't always work out the way you planned. why you even jump into this water? >> because madison famously said that if people were angels there would be no need for government. he also said taxes are the price we pay for freedom. tax policy has always been set to keep a dispersal of income. the middle income is important because we're the ones that spend the money and bill things. if you don't have the ones that can spend money and buy things the economy won't move. that is what has been happening. >> i can't argue that the tax system is fair or has been fair. we historically select those that benefit from tax breaks and those that will suffer from it. what effect do you think this would have? what would be the biggest downside? >> i don't see a downside to it. we're going to incentivize spokes. as a small business owner most of my life, if i pay 3 00% more to my median workers, i

wouldn't have a restaurant very long. one in four californians are in poverty. >> i don't understand how this necessarily raises that. for example, if you're in a business and you say ok, i'm paying these people this amount and this guy or gal is getting way up here and we whack them that is not necessarily going to go back to the workers, they are not going to get raises, just the shareholders or someone else gets a bigger dividend. no guarantee that money is going to the workers. >> no, no guarantee. but this is a series of bills. in my years of politics, very rarely is there one bill especially for something as complex as inequality in the united states. it's a whole series of bills we've come up with out of this caucus. it's important. >> what would the next step be? again, if the goal is to increase the wage of the middle class what would the next step be to do that? >> it's not one step. it's a series of steps and a conversation. this is one that is getting a lot of press but there's other things. earned income tax credit in the state of california.

we don't have that. that raises everybody up. we're going to raise the minimum wage. incentivize companies to make sure they pay their workers for the real value that is being done. >> in the real world, while we're having this conversation and if we raise the minimum wage in california as -- these companies you're trying to get to hire more people and pay them, they are going to move to another state. and possibly the ceo is going to go with them. and we'll lose the whole nine yards. >> right. if we follow that argument to its logical conclusion we just keep lowering the minimum wage so it's equal to third world countries. then we lose the wealth we have here. we all have to share in all the production we have here in california. this is the eighth largest economy in the world. we get 15% of the investment. there's a reason for. that there are bright hard working people here. we just want to make sure that everyone is part of our success. >> one of the reasons they are here, they are making boat loads of money. >> that's right. but how are they making that

here's what to expect in the sunday ahead, the clouds are going to be sticking around, we're going to see a very -- stay similar to what we saw yesterday. maybe a little cooler, staying cool into next week. highs today low 60s along the coast moving to the low 70s inland. temperatures are going to drop again tomorrow and then bottom out by the end of the day. then we're going to see this warm-up start, back in the 70s and 80s, could even see a warm weekend next weekend. mothers' day. fair warning, one week out. >> because of all that warmth tomorrow, cal fire will increase its staffing in northern california to get ready for fire season. it's hiring a training seasonal firefighter well ahead of schedule to support its full time force. the moves are in response to the recent hot weather and dry conditions. cal fire already responded to more than twice as many fires than average for this time of year. with california's drought, one of the worst in history, more water restrictions likely

a lot of surprises for that show, what do you think? >> i think there's a little bit, from what i hear on the street the fact that he opted to play there rather than the new 49er stadium in santa clara. a lot of people said civic pride, we're doing this, about a city celebration as much as anything else. the l.a. clippers franchise is getting a new leader. its owner donald sterling banned for life over the racist audio that leaked last saturday. the nba putting a new ceo now to see the team's day-to-day operations. clippers players are speaking out candidly now. >> i remember saturday morning when everything had hit you could see certain guys that are really -- that were really emotional about the situation. and this was the first day. it got a lot bigger. >> the nba wasn't the only group embarrassed by the sterling affair. >> the l.a. chapter of the naacp also found itself in the

spotlight. for having given clippers owner donald sterling a lifetime achievement award. despite repeated allegations that sterling's real estate company discriminated in the past. >> we sat down with carla marinucci from the san francisco chronicle and willie brown, no stranger to controversies like this. he's been on both sides and we asked his opinion of the sterling scandal >> sthaft, they are late, phil. they've known about this guy for many years. they just didn't do anything about it. they took action on what he said, not what he did. therefore, they still have egg on their face. >> how important is the public opinion component when it comes to professional sports? after all, a number of times it's the public that is not only buying the tickets but they are underwriting the stadium costs, the police protections. >> that's right. in this case i think it was huge. the public opinion came out so hard on this that the nba had no choice but to react strongly.

you saw mayor kevin johnson out there. >> the sacramento mayor? >> sacramento mayor, he looks good in this. the nba doesn't look so good in the long run. the naacp is the one that has egg on its face. >> i got to tell you something. the guy that looks the best of all is adam silver, the brand new guy, 90 days on the job and he was an understudy to david stern. what did he do? what david stern should have done. what do you think was the turn? that it went public so fast and everyone saw it so quickly? usually things bubble for a while. there's a back and forth. this was a - >> no, it was in the middle of the playoffs. when the players stepped up, when lebron james and others stepped up it became very clear that something had to be done immediately otherwise i think the players had planned not to play, throughout the league. that would have cost the owners a huge amount of money.

i mean like huge. >> we've seen this before. a lot of owners have very contentious relationships with the public. al davis, good example in the bay area. but sterling so crossed the line by insulting national heroes, magic johnson, it was just untenable. >> he's always been that way. fellow own you were knew he was that way. they don't invite him to their homes for anything. >> if he's always been that way and has these settlements he had to pay out or lawsuits for housing discrimination and such how does the naacp wind up giving him a -- an award? >> lifetime achievement? >> i don't speak for the naacp. it's an organization made up of just -- of collection of human beings, most of whom -- many of whom are not professional at all. and sometimes individual chapters do things that the nationals don't even know about. i'm certain going forward the naacp is going to have an approval process for everybody

in the future who is to be honored. >> i've heard two different opinions about silver's decision. some people said what he did was absolutely brave. others have said well, the momentum was already there, it was an easy decision for him. it was not anything brave. >> there's public opinion on his side. >> as the mayor and everybody pointed out the public is very invested in professional sports because we give them tax money for the arenas they play in and other amenities as well. so definitely a public relations trend to it. silver did what he had to do. as willie brown said he did it for himself as well. ,,,,,,,,
